1. Introduction

Welcome to Lasting Honor. By accessing our services, you agree to comply with these Terms and Conditions, which govern your use of our video biography services and related products.

2. Service Description

Lasting Honor specializes in creating personalized video biographies that capture and preserve life stories and family heritage. Our comprehensive services include pre-production planning, on-site filming, and professional post-production editing.

3. User Obligations

• Completion of the Discovery Form: We kindly request that clients complete the Discovery Form within 14 days from the date of purchase. This timely submission is crucial for us to begin the personalized preparation of your video biography. If you foresee any challenges in meeting this deadline, perhaps due to sickness or other significant personal matters, please reach out to us promptly. We are here to support you and can discuss possible accommodations to ensure the process remains smooth and stress-free.
• Be available for interviews and filming on agreed dates and times.
• Obtain necessary permissions for any third-party content included in the video.
• Acknowledge that environmental factors and safety considerations may affect video coverage.

4. Payment Terms

We offer a variety of package options and installment plans. Please see the Investment Page for your package and payment options.

5. Cancellation, Refund, and Rescheduling Policy

• Cancellations are fully refunded within 14 days of purchased: Full refund minus a $85 administrative fee.
• Cancellations are fully refunded after Discovery Form submission within 14 days: Full refund minus a $175 administrative fee.
• Cancellation following filming date confirmation: No refund.
• Note: No refund is issued post-confirmation of filming date due to significant preparatory work, including form review, questions customization, plot creation, team allocation, and other administrative tasks.
• Rescheduling a confirmed filming date for any reason other than a sickness signed by a clinic may incur a fee of up to $750.

6. Intellectual Property Rights

Clients are permitted to use the final video for personal, non-commercial purposes, unless given a written agreement by Lasting Honor.
Unless otherwise stated, the client grants Lasting Honor permission to use any images produced under this contract for display, broadcast, exhibition, promotion, and advertising purposes.

7. Liability and Indemnification

Lasting Honor is not liable for indirect or consequential damages arising from the use of our services.
Clients agree to indemnify Lasting Honor against any claims related to content they provide.
In the event of non-fulfillment of the contract due to unforeseen circumstances, liability is limited to a refund of all payments received. This limitation also applies to loss or damage of materials due to processing errors, camera malfunction, or other incidents. The client acknowledges the impossibility of re-enacting events for reshoots.

8. Editorial Control and Additional Charges

Two revisions included. Any additional revision is paid by an hourly rate of $85 per hour.
Parking at clients’ location, entry fees and toll expenses incurred during filming will be billed to the client.

9. Service Relationship with Fancy Design LLC

We would like to inform our users that LastingHonor.com is a service provided by Fancy Design LLC. While LastingHonor.com operates as a distinct entity, it is supported and managed by Fancy Design LLC. This connection enhances our ability to deliver high-quality services through specialized attention and resources. However, it is important to note that the use of LastingHonor.com is governed by its own specific terms and conditions, which are separate from those of Fancy Design LLC. We encourage our users to review these terms carefully to understand the guidelines and policies specific to LastingHonor.com.

10. Changes to Terms

Lasting Honor reserves the right to modify these terms. Continued use of our services constitutes acceptance of these changes.

11. Governing Law

This agreement is governed by the laws of Florida, irrespective of conflict of law principles.
